Abstract (English):
The article defines that the subject of individual contractual regulation is a set of relations that arise between an employer and an employee in the course of the latter’s performance of a labor function and the implementation of other terms of an employment contract. Individual contractual regulation has its own peculiarities regarding subjects, subject matter and legal form. The employee and the employer as subjects of individual contractual regulation have their own interests. First of all, they are interested in the stability of labor relations. It is argued that labor law includes a combination of both private and public methods of legal regulation, individual and collective interests, which are influenced not only by internal factors, but also by external factors that form the basis of economic relations. The subject of labor explains the complexity of legal regulation, inequality in the legal status of the parties to labor relations and attempts to artificially align them; providing broader preferences to one of the parties. The lack of a solution to this problem aggravates social relations and does not entail the expected result.
