To ensure the rights, freedoms and legitimate interests of the individual in the criminal process of Russia, the institute of judicial control is actively functioning. One of its types is control over the legality and validity of the production of investigative actions. Such procedural actions include exhumation in the absence of the consent of relatives. However, there are significant problematic aspects regarding judicial authorization of the investigative action in question, which will be discussed in the article.
