ON THE ISSUE OF PERIODIZATION OF THE FORMATION OF REQUIREMENTS AND RULES FOR THE DESIGN OF A NORMATIVE LEGAL TEXT IN PRE-REVOLUTIONARY RUSSIA

Abstract (English):
The problem of the design of the normative legal text is currently very relevant, since any deviations from the accepted standards form negative legal consequences, which can be difficult or impossible to overcome or eliminate at all. Thus, violation of the rules of registration, which are full of modern regulatory legal acts, entails a lot of negative legal phenomena, including: mistakes in law enforcement, destabilization of public relations, distortion of the original intention of the legislator, undermining the authority of the authorities and, as a consequence, legal nihilism. The rules and requirements for the design of a normative legal text need to be improved, and for this it is necessary to take into account all previously accumulated experience, identify and systematize it. The scientific article is devoted to one of the little — studied and at the same time fundamental issue — the periodization of the formation of requirements and rules for the design of a normative legal text. The article defines the reasons and conditions for the formation of rules for the design of a normative legal text, analyzes the essential content features, identifies the stages of evolution of the formation of requirements and rules for the design of a normative legal text and gives their characteristics. The established periodization will make it possible to better understand the dependence of the design of the normative legal text on historical conditions, determine the features of Russian law-making and prepare recommendations for the legislator.
