THE MECHANISM OF LEGAL PROTECTION OF THE IMAGE OF THE LAW ENFORCEMENT SYSTEM IN MODERN CONDITIONS
Abstract and keywords
Abstract (English):
The article discusses the problematic aspects of protecting the image of the law enforcement system. The necessity of understanding the functioning of the mechanism of legal protection of the image of the law enforcement system in the difficult conditions of modern reality, the identification and practical application of the legal means provided for by the current domestic legislation to ensure the safety of all structural elements of this system is substantiated. In view of the high achievements of mankind in the field of modern technologies, including the level of development of virtual space, the author emphasizes the particular danger of the rapid spread of purposefully distorted in the negative side of both the individual image (image of law enforcement officers) and the image of the organization (law enforcement system as a whole) information through various sources. Regulatory legal sources and judicial practice are analyzed, on the basis of which the author draws conclusions about possible ways to protect the image of the law enforcement system, taking into account the division of the latter into personal image (the image of an individual law enforcement officer) and corporate image (the image of the law enforcement system as an organization). It is concluded that the mechanism of legal protection of the image of the law enforcement system currently exists in the form of a set of special legal instruments (substantive and procedural means in interaction) used to regulate legal relations arising in the relevant sphere. However, its functioning occurs “indirectly” through the use of available legal structures.
