Abstract (English):
he article deals with the problem of effective criminal legal counteraction to criminal violation of labor protection requirements (Article 143 of the Criminal Code of the Russian Federation). The specificity of the subjective side of the crime in question consists in a combination of a person’s mental attitude to the violation of the established requirements and the consequences provided for in Article 143 of the Criminal Code of the Russian Federation. The author substantiates the increase in public danger in the case of intentional violation of the established requirements and concludes that it is necessary to improve criminal and legal labor protection in terms of strengthening responsibility in the case of establishing signs of intentional violation of labor protection requirements during the qualification of a crime.
