Рассматривается проблема юридической аномии через призму формирования текста Основного закона Российской Федерации. Отмечено, что Конституция Российской Федерации была подготовлена в соответствии с классическими западными образцами, однако существующая в российском государстве общественно-политическая ситуация не была учтена должным образом. Многие положения принятой Конституции Российской Федерации имели декларативный характер, не отвечали фактически сложившемуся состоянию социальных отношений с учетом их исторического развития, в связи с чем многие требования Основного закона могли бы быть выполнены только в будущем. Установление конституционных норм в условиях отсутствия в Российской Федерации сложившегося действенного механизма их обеспечения с неизбежностью привело к усилению уже существующего в обществе состояния юридической аномии.
