В данной статье рассматриваются основные тенденции в сфере защиты общественных отношений от преступных посягательств с использованием криптовалют в Республики Индия с целью возможного получения положительно опыта для совершенствования законодательства Российской Федерации в области борьбы с цифровой преступностью. Проведен анализ индийской правовой системы на предмет эффективности противодействия с цифровой преступности с использованием виртуальных валют, а также изучен правовой статус цифровых финансовых активов как источника криминологических рисков. Изучены особенности уголовно-правового толкования термина «криптовалюта», как признака совершенного преступления.

This article discusses the main trends in the field of protecting public relations from criminal encroachments using cryptocurrencies in the Republic of India in order to possibly gain positive experience in improving the legislation of the Russian Federation in the field of combating digital crime. The analysis of the Indian legal system for the effectiveness of combating digital crime using virtual currencies was carried out, and the legal status of digital financial assets as a source of criminological risks was studied. The features of the criminal-legal interpretation of the term — cryptocurrency, as a sign of a committed crime, are studied.
