Рассматривается понятие и дается определение праву на солнечный свет (праву на инсоляцию) в России и в зарубежных странах. Анализируется аналогичное право в Японии, обозначаемое как «Nisshoken», и Великобритании, известное как «right to light». Уделяется внимание значению солнечного света для человека, в том числе обосновывается потребность человека в эстетическом переживании. Исследуются основные нормативные правовые акты России и ряда зарубежных стран в сфере реализации права на солнечный свет. Проиллюстрированы способы защиты права на солнечный свет, приводятся примеры из судебной практики России, Японии и Великобритании.

The concept and definition of the right to sunlight (the right to insolation) in Russia and in foreign countries are considered. A similar right is analyzed in Japan, referred to as «Nisshoken», and in the United Kingdom, known as «right to light». Attention is paid to the importance of sunlight for a person, in particular, the need for a person’s aesthetic experience is justified. The main normative legal acts of Russia and a number of foreign countries in the field of realization of the right to sunlight are studied. Ways to protect the right to sunlight are illustrated, and examples from the judicial practice of Russia, Japan, and the United Kingdom are given.
